(1) The position vacated by an employee participating in the program shall remain vacant unless it is filled:

(a) In a manner that ensures at least a 25 percent reduction in the annual wage rate; and

(b) Pursuant to the requirements of chapter 3.90 SCC.

(2) In a year in which the program is activated after October 1st, the position may be filled in the current calendar year based on ensuring at least a 25 percent reduction in the annual wage rate for either the current or following year.
