To be eligible for program incentives, an eligible employee approved to participate in the program must enter into a written participation agreement that sets forth the terms and conditions of his or her voluntary separation, including but not limited to:

(1) The employee will submit a written resignation that is accepted by the county and effective no later than December 31st of the year in which the employee applies for the program. The participation agreement may establish deadlines and procedures, which may vary by department, for employee participation in the program;

(2) The employee must agree not to seek reemployment with the county, the county superior court, and/or the county district court in any position;

(3) The employee must agree that if he or she applies for and receives unemployment compensation, the monetary program incentive will be forfeited; and

(4) The employee must sign a waiver and release of all claims under the Age Discrimination in Employment Act and the Older Worker Benefit Protection Act. (Added by Amended Ord. 20-058, Oct. 19, 2020, Eff date Oct. 30, 2020).
