(1) In order to be eligible for the program, an employee must be an eligible employee and retirement ready. While the employee must enter a participation agreement and submit a letter of resignation effective on or before December 31st of the current calendar year, the employee is not required to begin drawing a pension to be considered eligible for the program.

(2) An employee is ineligible for the program if the employee:

(a) resigned, retired or submitted written notification of the employee’s intent to do so before the employee became an eligible employee and/or the council activated the program in the current calendar year; or

(b) works in a layoff unit in which any employee received a layoff notice before the employee submitted a program application under SCC 3.95.050; or

(c) works in a classification in which half or more of the positions in the same department and classification as budgeted in the previous calendar year are subject to the restrictions in SCC 3.95.080 or a pending program application under SCC 3.95.050.
