(1) Any county department or office may request that a county LEED eligible project be exempted from the requirements of this chapter by submitting an exemption request to the executive.

(2) The executive may exempt a county LEED eligible project from the requirements of this chapter when a county department or office demonstrates:

(a) Compliance with the requirements of this chapter would impair the historic integrity of the building, structure or facility listed on a local, state, or federal list or register of historic structures;

(b) Compliance with the requirements of this chapter creates a conflict with state or federal law, rules, regulations or codes; or

(c) The requirements of this chapter are inconsistent with the terms of any grant or other financial award.

(3) The county council may by motion exempt a county LEED eligible project from the requirements of this chapter if it finds that such exemption is in the public interest. In granting the exemption, the county council shall consider whether a lower level of LEED certification or alternative sustainable building standard should be required.
