(1) In addition to a franchise, utility purveyors are required to obtain a right-of-way use permit as specified in chapter 13.10 SCC to work in the right-of-way for the construction or maintenance of facilities.

(2) Notwithstanding the requirement in subsection (1) of this section, work within the right-of-way may be permitted if the engineer determines that the proposed work is necessary to address a specifically-identified public health hazard, a specifically-identified actual or imminent damage to county right-of-way, or specifically-identified hazards to users of county right-of-way.
