30.44.040 Letter of exemption from the shoreline substantial development permit requirements.
(1) When a development falls within the exemptions stated in SCC 30.44.020 or 30.44.120, the department shall prepare a letter addressed to the applicant and the regional office of the department of ecology, exempting the development from the shoreline substantial development permit requirements of chapter 90.58 RCW when either of the following applies:
(a) The development is subject to a U.S. Corps of Engineers Section 10 permit under the Rivers and Harbors Act of 1899, or a Section 404 permit under the federal Water Pollution Control Act of 1972; or
(b) The property owner requests an official letter of exemption.
(2) All shoreline exemptions stated in SCC 30.44.020 and 30.44.120 shall be tracked within the county AMANDA data base tracking system. (Added by Amended Ord. 12-025, June 6, 2012, Eff date July 27, 2012; Amended by Amended Ord. 19-020, July 3, 2019, Eff date Oct. 14, 2019).
