Site improvements in final plats, short plats, and binding site plans shall be maintained as follows:

The applicant shall submit to the department, prior to final plat, final short plat, or binding site plan approval, covenants, deeds, and homeowners’ association bylaws, and other documents guaranteeing maintenance and common fee ownership, if applicable, of open space, community facilities, private roads and drives, and all other commonly-owned and operated property. These documents shall be submitted in a form acceptable to the director and accompanied by a certificate from an attorney that they comply with the requirements of this chapter. Such documents and conveyances shall be accomplished and be recorded, as applicable, with the county auditor simultaneously with the recording of any final plat, final short plat, or binding site plan with record of survey of the property or division thereof.
