(1) Sites with an active conditional use permit or administrative conditional use permit issued pursuant to this chapter that are approaching depletion of all commercially significant mineral resources on the site may enter into a development agreement under chapter 30.75 SCC to address reclamation and transition into post-extractive uses.

(2) Development agreements under subsection (1) of this section may allow grading, utility installation, landscaping, and other necessary components of the development not inconsistent with ongoing mining to occur upon approval but will prohibit final subdivision or short subdivision approval and issuance of any building permit not directly related to mining operations until the completion of surface mining as defined by RCW 78.44.031(2) on the site.
