(1) The following Snohomish County entities may request covered entities provide protected health information related to the federally determined emergency concerning the opioid crisis:

(a) Snohomish County health authorities acting as authorized by law in response to the public health emergency;

(b) Snohomish County officials who are reasonably able to prevent or lessen the serious and imminent threat to public health; or

(c) Snohomish County law enforcement, when the circumstances of the emergency implicate law enforcement activities.

(2) Upon receiving a request pursuant to subsection (1) of this section, the covered entity shall provide the requested information, including individually identifiable health information, in accordance with 45 CFR 164.512(b), (f), and (j). Covered entities include, but are not limited to, Snohomish County EMS council, all public and private EMS and fire agencies operating in Snohomish County.

(3) On or before January 31st and on or before July 31st, the Snohomish County opioid response multi-agency coordination group shall submit a written report to the Snohomish County council that describes how the sharing of HIPAA protected information pursuant to this section has served to aid Snohomish County’s response to the opioid crisis.
