(1) It is unlawful for any person to slaughter a horse if that person has knowledge that any of the horse meat will be used for human consumption.

(2) Violation of this section is a misdemeanor punishable by a fine of not more than $1,000 and/or by incarceration for not more than 90 days.

(3) This section shall not apply to:

(a) Any noncommercial activity; or

(b) Any activity within an incorporated city or town; or

(c) Any person who sells a horse to a buyer who in turn either (i) himself slaughters the horse for human consumption, or (ii) resells the horse to another person who slaughters the horse for human consumption. (Added by Amended Ord. 12-106, Dec. 19, 2012, Eff date Jan. 12, 2013).
